Partner Ed Sweeney won a second jury trial in two months, receiving a verdict of just over $200,000. Sweeney represented a Corrections Officer, Darick Easterling, who worked for over 19 years at the County of Delaware prison, which was run by private entities. He had a medical condition. The last private entity, GEO, had accommodated his disability, which put a restraint on his ability to work long shifts. However, in April 2022, the County of Delaware required that when it took back under direct public control the prison, a prison guard work two eight-hour shifts in a row. Easterling requested reasonable accommodations for his disability, which the County denied. Because he could not work the now-required hours, he was terminated. Our firm sued for violation of the Americans with Disabilities Act and the Pennsylvania disability law. A federal jury in Philadelphia
found that the County discriminated against him and violated his right to reasonable accommodation. In the damages stage of the trial, the trial Court awarded a verdict of just over $200,000 in back and front pay.
